Artist Terms of Use

1. Purpose, acceptance and relationship with the Terms of Use

These Artist Terms of Use ("Artist Terms") supplement the Terms of Use ("Terms") of the INK3D mobile application (the "Application"), published by Girard R., sole proprietorship registered in the Trade Register of the canton of Fribourg under No. CHE-185.324.859, whose registered office is at Route d'Hennens 39, 1681 Billens, Switzerland (hereinafter "the Publisher" or "INK3D"). They apply to any user holding "Artist" status.

Express acceptance of these Artist Terms (checkbox) is mandatory when creating an Artist account or when switching an "Enthusiast" account to "Artist" status. In the event of a conflict between the Artist Terms and the Terms, the Artist Terms prevail for everything relating to Artist status and payments.

2. Independent artist status — merchant of record

The artist is an independent professional. Tattoo services are contracted directly between the artist and their client: the artist is the merchant of record of each transaction and bears sole contractual, commercial and legal responsibility for it. INK3D only provides the technical infrastructure for connection and payment and is not a party to the service contract.

The artist is solely responsible for the compliance of their activity with the laws applicable to them: professional authorizations and licenses, hygiene and health rules, professional insurance, obligations towards their clients (information, consent, legal age), and any other local requirement relating to the practice of tattooing.

3. Stripe payment account and Connected Account Agreement

To receive payments via the Application, the artist must create a connected account with the payment provider Stripe, via the onboarding flow offered in the Application. During this onboarding, the artist accepts the Stripe Connected Account Agreement (full services agreement), which directly governs their relationship with Stripe.

Payments (deposits and balances) are processed directly on the artist's Stripe account. The artist has a full Stripe dashboard, is responsible for the accuracy of the identification information provided to Stripe (KYC), and manages their bank payouts, refunds and disputes from this dashboard.

4. Stripe processing fees borne by the artist

The processing fees charged by Stripe on each payment are borne exclusively by the artist. They are automatically deducted from each transaction before it is credited to the artist's Stripe balance.

Why these fees cannot be passed on to the client: applicable regulations prohibit or restrict increasing the price according to the payment method ("surcharging") — notably the European Payment Services Directive (PSD2) and its national transpositions (surcharging is for example prohibited in France, Italy and the United Kingdom), the Visa and Mastercard network rules, as well as Klarna's merchant terms which prohibit penalizing this payment method. This is why the artist is asked to build these fees into the price of their services rather than adding them at the time of payment.

For information, Stripe's standard fees by country of the artist's account are as follows:

Indicative figures as of July 3, 2026, collected from stripe.com/pricing (and its country-specific versions). Intermediate rates exist ("premium" cards, cards issued in other regions) and Klarna pricing varies by country and product. The only contractual reference is the pricing displayed in the artist's Stripe dashboard. Currency conversion only applies if the payment currency differs from the settlement currency of the artist's Stripe account.

5. Refunds

Any refund of a payment (deposit or balance), whether decided by the artist or triggered automatically by the Application (for example when a payment is made after an appointment has expired), is debited from the artist's Stripe balance. The processing fees of the original payment are not returned by Stripe.

The artist acknowledges in particular that:

  • a refund may make their Stripe balance negative, in which case Stripe recovers the amount from their subsequent earnings or their bank account;
  • if the balance is insufficient, a refund may fail or remain pending until sufficient funds are available; the artist undertakes to regularize their balance without delay;
  • the refund conditions communicated to the client in the Application at the time of payment are binding on them.

6. Payment disputes (chargebacks)

If a client disputes a payment with their bank or payment provider ("chargeback"), the disputed amount as well as the dispute fees charged by Stripe are borne by the artist and debited from their Stripe balance. The artist manages disputes from their Stripe dashboard and provides the requested evidence within the applicable deadlines.

INK3D is not a party to commercial disputes between the artist and their client and assumes no liability in this respect, in accordance with article 8 of the Terms.

7. Platform commission

During the beta phase of the Application, INK3D charges no commission (0%) on artists' transactions. INK3D reserves the right to introduce a commission at a later date, subject to at least thirty (30) days' notice given in the Application or by email. Continued use of the payment features after a commission takes effect constitutes acceptance of it.

8. Deposits, cancellations, no-shows and expiration

The artist may request a deposit to confirm an appointment. The deposit is included in the final price of the service. Unless the artist expressly agrees otherwise, the deposit is not refunded in the event of cancellation by the client or no-show, in accordance with article 12a of the Terms.

Appointment proposals and deposit requests have a limited validity period, displayed in the Application. Upon expiry, the appointment expires automatically; a deposit paid after expiration is automatically refunded to the client (processing fees remaining at the artist's expense, see article 5).

9. Currencies and exchange rates

The artist chooses the currency of their services from those offered by the Application. Payments are processed in the currency chosen by the artist. Depending on this currency and the client's country, certain payment methods (notably installment payments via Klarna) may be unavailable; the Application indicates this where applicable.

When a payment or refund involves a currency conversion (by the client's payment provider or by Stripe), the amount finally received or returned may vary by a few percent due to exchange rates and conversion fees.

10. VAT and tax obligations

The artist is solely responsible for all tax and social obligations related to their activity: declaration and payment of VAT where applicable, taxes, social contributions, bookkeeping and issuing invoices to their clients. The amounts and statistics displayed in the Application (summaries, estimated revenue) are provided for information purposes only and constitute neither accounting nor tax documents.

11. Eligible countries

The payment features of Artist status are available to artists established in the following countries: Switzerland, member states of the European Economic Area (EEA), United Kingdom, United States and Canada. INK3D may change this list at any time; effective eligibility also depends on the acceptance of the artist's file by Stripe.

12. Agenda visibility

The artist acknowledges and accepts that the availability they publish in their INK3D agenda (slots open for booking) is visible to other users of the Application in order to enable appointment booking.

13. Definitive nature of Artist status

Switching to Artist status is definitive: an Artist account cannot revert to "Enthusiast" status. This information is recalled at the time of the choice, which requires express confirmation. An artist who no longer wishes to use the Artist features may simply stop using them, or delete their account under the conditions provided for in the Terms; the status itself, however, is not reversible.

14. Suspension and termination

INK3D reserves the right to suspend or withdraw access to the Artist features, or to terminate the account, in the event of a violation of these Artist Terms or of the Terms, without notice or refund. Suspension or termination does not release the artist from obligations arising beforehand (refunds due, ongoing disputes, tax obligations). The artist's relationship with Stripe remains governed by the Stripe Connected Account Agreement.

15. Applicable law and contact

These Artist Terms are governed by Swiss law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the canton of Fribourg. For any question, contact us at contact@ink3d.app.
